Overview

Welcome to MediScan ID. These Terms of Service (“Terms”) govern your use of our website, products, and services, including our NFC-enabled wristbands and digital medical profile system (the “Services”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Services.


1. Important Medical Disclaimer

MediScan ID is not a medical device, healthcare provider, or emergency service.

  • Our products are designed to assist in communicating information during an emergency

  • We do not guarantee that emergency responders, bystanders, or medical personnel will scan your device, access your profile, or act on the information provided

You acknowledge that:

  • MediScan ID does not replace medical advice, diagnosis, or treatment

  • You remain solely responsible for your health, safety, and medical care decisions


2. User Responsibility

You are solely responsible for:

  • Ensuring your profile information is accurate, complete, and up to date

  • Keeping emergency contact details current

  • Activating and maintaining your MediScan ID profile

  • Ensuring your device is worn and accessible

We are not responsible for:

  • Incorrect or outdated information in your profile

  • Failure of third parties to respond or act

  • Any consequences arising from reliance on your profile data


3. Product & Service Nature

MediScan ID provides:

  • A physical NFC-enabled wristband

  • A digital profile linked to that device

  • Subscription-based access to profile management and emergency features

You acknowledge that:

  • The product relies on third-party technology (e.g. smartphones, NFC compatibility, internet access)

  • Functionality may vary depending on device, environment, or network availability


4. No Guarantee of Emergency Response

We do not guarantee that:

  • Your wristband will be scanned in an emergency

  • Emergency services will access or rely on your information

  • Your emergency contacts will be reachable or respond

MediScan ID is a support tool only, not a guaranteed safety system.


5. Account & Profile Use

You must:

  • Provide accurate and complete information

  • Maintain the security of your account

  • Not share or misuse another person’s profile

We reserve the right to suspend or terminate accounts that contain:

  • False information

  • Misleading medical data

  • Abuse of the system


6. Subscriptions & Activation

Some features require an active subscription.

  • Subscription fees are billed as set out on our product page at mediscanid.com.au1

  • You may cancel at any time to prevent future billing

  • Once your profile is activated, the service is considered delivered

  • Subscription fees already charged are non-refundable except where required by Australian Consumer Law


6A. Assisted Profile Setup Service

MediScan ID offers an optional assisted profile setup service for customers who require help completing their digital medical profile.

  • A one-time fee of $35 applies for this service, payable at the time of booking

  • This fee covers the initial setup of your profile only. Any subsequent changes or updates to your profile are at our discretion and may be subject to additional charges

  • By using this service, you authorise MediScan ID to enter information into your profile on your behalf, based solely on the information you provide to us

  • You remain solely responsible for the accuracy and completeness of your profile. You must review your profile after setup and notify us promptly of any errors or omissions

MediScan ID accepts no liability for inaccuracies in your profile that result from information provided to us by you or a third party acting on your behalf.


7. Returns & Refunds

All purchases are subject to our Returns & Refund Policy, available at mediscanid.com.au.

  • Refunds may be available within 30 days of delivery, prior to profile activation

  • No refunds are available once the profile has been activated

  • Faulty products will be handled in accordance with Australian Consumer Law


8. Limitation of Liability

To the maximum extent permitted by law, MediScan ID is not liable for:

  • Injury, illness, or death

  • Delayed or failed emergency response

  • Inaccurate or inaccessible profile information

  • Failure of the product to be used in an emergency

This includes any indirect or consequential loss arising from use of our Services.


9. Third-Party Reliance

Our Services may depend on mobile devices, internet connectivity, emergency responders, and third-party platforms. We are not responsible for the performance or actions of any third party.


10. Intellectual Property

All content, branding, and technology associated with MediScan ID remain our property. You may not copy, reproduce, distribute, reverse engineer, or replicate our system or content.


11. Termination

We may suspend or terminate your access if you breach these Terms, misuse the platform, or provide false or harmful information.


12. Dispute Resolution

We are committed to resolving any concerns fairly and efficiently.

If you have a complaint or dispute, we encourage you to contact us first at chantal@mediscanid.com and allow 14 business days for us to resolve your concern before escalating to Consumer Affairs Victoria, the Australian Competition and Consumer Commission (ACCC), or your state’s Fair Trading body.

We will acknowledge your complaint within 2 business days and work with you in good faith to reach a resolution.


13. Australian Consumer Law

Nothing in these Terms excludes your rights under Australian Consumer Law. Where required by law, remedies such as repair, replacement, or refund will be provided.


14. Governing Law

These Terms are governed by the laws of Australia.


15. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email to your registered address or via notice on our website. Continued use of the Services following notification constitutes acceptance of the updated Terms.2

1 Current pricing is displayed on the MediScan ID product page at mediscanid.com.au. Prices are subject to change. Any change in subscription pricing will be communicated to existing subscribers in advance.

2 Where changes are material — such as changes to fees, data handling, or your rights — we will provide at least 14 days’ notice before they take effect. If you do not wish to accept the updated Terms, you may cancel your subscription prior to the effective date.
